The EAD/ETA route under the new Construction Products Regulation 2024/3110

The Construction Products Regulation 2024/3110 (hereinafter “CPR-24”) was published in the Official Journal of the EU (OJEU) on 18th December 2024 and entered into force on 7th January 2025. Relevant parts of the CPR-24 will apply from 8th January 2026. The CPR-24 will replace the CPR 305/2011 (hereinafter “CPR-11”).
1. Further applicability of CPR-11
CPR-24 will be applicable only for construction products which are CE marked based on hEN or EADs which will be published under the provisions of CPR-24 after the 7th January 2026. For products according to hEN or EADs published under the CPR-11, the provisions of CPR-11 continue to apply, unless the respective hEN or EAD is replaced by a new version under the CPR-24.
This means for products with ETA issued under the CPR-11, that the following information required by CPR-24 are not mandatory:
- Environmental essential characteristics,
- Safety instructions,
- Machine readability of performance data.
2. Harmonized zone under CPR-24
CPR-24 established a “harmonized zone”, which is a novelty compared to CPR-11. This zone covers products which are in the scope of hEN. For those products, member states are not allowed to define additional requirements for products.
EADs are not part of this harmonised zone but based on experience with CPR-11 (were no harmonized zone was defined), it is not expected that member states will define additional requirements for products covered by EADs under the CPR-24.
3. Status of EADs and ETAs under CPR-24
a. “Published EADs”: EADs which are cited in the OJEU under CPR-11 before 8th January 2026:
- Published EADs will remain valid until 9th January 2031, unless they are not replaced by new versions.
- Until this date, those EADs can be used to issue new ETAs based on CPR-11.
- ETAs issued based on those EADs stay valid until 9th January 2036, unless they are not replaced by new editions.
b. “Adopted EADs”: EADs which were adopted by EOTA and sent to the European Commission for publication, but not cited in the OJEU before 8th January 2026:
- Under CPR-11, those EADs were used to issue ETAs. The issue of at least one ETA was one prerequisite for the citation of the EAD in the OJEU.
- Those EADs can be used to issue new ETAs until 8th January 2026.
- Under CPR-24, ETAs based on adopted EADs remain valid as technical documents but cannot be used as basis for CE marking and DoPC.
- EOTA intends to continue to list those ETAs in the ETA database under eota.eu.
- Performance data from those ETAs can be used under national building codes to design fastening applications based on Eurocode or the respective EOTA Technical Report.
- To keep the reliability of those ETAs, CFE recommends maintaining – on a voluntary basis – the procedures defined in the respective AVCP system including the external factory production control (FPC) by an accredited body.
4. Development of new ETAs or EAD versions under CPR-24
Under CPR-11, the issue of at least one ETA based on an adopted EAD was one prerequisite for the citation (publication) of this EAD in the OJEU. Under CPR-24, this sequence will change. After 8th January 2026, ETAs can only be issued based on published EADs after citation on the OJEU.
In addition to the technical content of EADs under CPR-11 (assessment procedures), EADs developed under CPR-24 shall include:
- all essential characteristics related to environmental sustainability (life cycle assessment indicators according to EN 15804),
- the guidelines, including technical details necessary for drawing up general product information, instructions for use and safety information and
- the guidelines to ensure interoperability of the human and machine readable formats for the declaration of performance and conformity.
