New Construction Products Regulation 2024Transition provisions for EADs and ETAs under the new CPR

Current EADs and ETAs under the new CPR

It is expected that the new CPR will come into force in November 2024 and will be fully applicable from the "date of application" (DOA) in November/December 2025.

What does this mean for EADs and ETAs from the current CPR?

  1. Under the current CPR, ETAs have an unlimited validity. This will change under the new CPR. ETAs will stay valid for 5 years after the respective EAD was replaced by a new version. This will be applied also for ETAs issued under the current CPR.
  2. EADs which were cited in the Official Journal of the EU under the new CPR will stay valid for 5 years after the date of application of the new CPR.
    • ETAs based on those EADs will remain valid for additional 5 years (in total 10 years after DOA).
  3. ETAs issued based on ETAGs (European Technical Approval Guidelines) used as EADs in the transition period from the former Construction Products Directive to the current CPR can no longer be used as basis for CE marking after the DoA. Those ETAs can be further used as technical documents to proof the performance of the products.
